Telidox on behalf of itself and its affiliates/group companies under the brand "Telidox" (“Telidox”), is the author and publisher of the internet resource www.telidox.com and the mobile application ‘Telidox’ (together, “Website”). Telidox owns and operates the services provided through the Website, the mobile / tablet application Telidox (hereinafter referred to as “Application” or “App”), and shall provide services within India and the continent of Africa. The domain name telidox.com (herein after referred to as "Website") is owned by Telidox /Medicare Investigation and Services Private Limited(MISPL) a company incorporated under the Companies Act, 1956 with its registered office at GF-2/39, Sampatrao colony, Alkapuri, Vadodara-390007 India .Medicare Investigation and Services Private Limited(MISPL) have been availing off the services from Telidox.
2. This app has its uniqueness which can connect Indian And African Doctors to patients who resides in India/Africa and are in need of good health services. The services of Telidox are essentially provided to bridge the information gap between patients and doctors and provide medical services.
3. This document is an electronic record in terms of IT Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the IT Act, 2000 – in addition to the local laws governing such activities in all countries Telidox operates in. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the IT (Intermediaries guidelines) rules, 2011 that require publishing the rules and regulations, privacy policy and terms of use for access or usage of service – in the country of India
4. By downloading or accessing the Website/App to use the Services, you irrevocably accept all the conditions stipulated in this Agreement , terms and conditions or privacy policy, the Subscription Terms of Service and Privacy Policy , as available on the Website/App, and agree to abide by them. This Agreement supersedes all previous oral and written terms and conditions (if any) communicated to you relating to your use of the Website/App to avail the Services. By availing any Service, you signify your acceptance of the terms of this Agreement.
5. We reserve the right to modify or terminate any portion of the Agreement for any reason and at any time, and such modifications shall be informed to you in writing you should read the Agreement at regular intervals. Your use of the Website/App following any such modification constitutes your agreement to follow and be bound by the Agreement so modified.

We request you to carefully go through these terms of use ("Terms of Use") before you decide to avail the services of Telidox by registering with the company to avail our services, you irrevocably accept all the obligations stipulated in these terms of use and agree to abide by them. Accessing the website through any medium, including but not limited to mobile phones, smart phones and tablets, are also subjected to these terms of use. These terms of use supersede all previous oral and written terms and conditions (if any) communicated to you. By using this Website, you signify your agreement to these Terms of Use as well as the website's www.telidox.com (which is hereby incorporated by reference herein). We reserve the right to modify or terminate any portion of the website or the services offered by the company for any reason, without notice and without liability to you or any third party. To make sure you are aware of any changes, please review these terms of use periodically. The website should not be used in cases of medical emergencies and Telidox does not, and should not be considered in any form to be a substitute for a physical doctor or a physical hospital visit.
7. We encourage you to independently verify any information you see on the website with respect to a doctor or healthcare provider that you seek to make an appointment registration: If you wish to schedule an appointment with a doctor or conduct a transaction on the app, you will have to register on the app and become a registered and duly authorized user ("Telidox User") prior to the completion of any transaction on the Telidox. To register onto the website, a user will have to provide information such as his/her name, email address and phone number and create a username and password. You understand that Telidox may introduce a fee for registration on the website ("Registration Fees"). Registration Fees, if and when introduced shall be non-refundable. Telidox may introduce special features which may be made available to Telidox users who pay registration fees. Registration is only a one time process and if the Telidox user has been previously registered, she/he shall login/sign into his/her account using the same credentials as provided during the registration process. We request you to please safeguard your password to your account on the app and make sure that others do not have access to it.
8. You acknowledge that you will be bound by this Agreement for availing any of the Services offered by us. If you do not agree with any part of the Agreement, please do not use the Website, app or avail any Services.
9. Your access to use of the Website/ app and the Services will be solely at the discretion of Telidox.
10. These Terms and the Privacy Policy together constitute a legal agreement (“Agreement”) between you and Telidox in connection with your visit to the Website and your use of the Services (as defined below).
11. It provides services and facilitates in finding registered and authorised doctors , pharmacies, diagnostic centres and pathology laboratories and other authorised healthcare providers not only to the Indian patients but also the patient that stays outside India for eg Uganda to connect and consult with Indian/African doctors.
12. The Agreement applies to you whether you are -
a. A medical practitioner or health care provider (whether an individual professional or an organization),Pharmacist, Lab Technicians, Hospitals, Dispensaries, direct patients or similar institution wishing to be listed, or already listed, on the Website, including designated, authorized associates of such practitioners or institutions (“Practitioner(s)”, “you” or “User”); or
b. A patient, his/her representatives or affiliates, searching for Practitioners through the Website or App (“End-User”, “you” or “User”); or
c. Otherwise a user of the Website or App (“you” or “User”). This Agreement applies to those services made available by Telidox on the Website or App, which are offered at the charges decided by Telidox to the Users (“Services”), including the following:
d. For Practitioners: Listing of Practitioners and their profiles and contact details, to be made available to the other Users and visitors to the Website or downloading the Telidox app; and getting it registered on the app
e. For Pharmacist: Listing of Pharmacist and their profiles and contact details, to be made available to the other Users and visitors to the Website or downloading of the Telidox app and getting it registered on the app
f. For Diagnostic Centres/ Path Labs: Listing of Diagnostic Centres/ Path Labs and their profiles, to be made available to the other Users and visitors to the Website or downloading the Telidox app and getting it registered on the app
g. For other registered healthcare providers : Listing of Practitioners and their profiles, to be made available to the other Users and visitors to the Website or downloading of an telidox app and getting it registered on the app.
h. For other Users: Facility to
(i) create and maintain ‘Health Accounts’,
(ii) search for Practitioners by name, specialty, and geographical
area, or any other criteria that may be developed and made
available by Telidox, and
(iii) to make appointments with Practitioners in India And
Africa
The Services may change from time to time, at the sole discretion of Telidox, and the Agreement will apply to your visit to and your use of the Website/App to avail the Service, as well as to all information provided by you on the Website/App at any given point in time.
The download of the telidox app is free of charge but the service fees of the User shall be based on the choice of the practitioner, pharmacy, path labs and diagnostic centre and shall be decided by Telidox.
13. This Agreement defines the terms and conditions under which you are allowed to use the Website/App and describes the manner in which we shall treat your account while you are registered as a member with us. 14. The Agreement is published in compliance of, and is governed by the provisions of Indian law and also Uganda Law, including but not limited to:
a the Indian Contract Act, 1872, and The Uganda contract act 2010
b the (Indian) Information Technology Act, 2000, and Uganda Information Technology Act
c the rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).
d THE JURISDICTION AND ARBITRATION FOR ANY TECHNICAL, LEGAL, FINANCIAL, ADMINISTRATIVE OR ANY OTHER DISPUTE(S) WOULD BE VADODARA, GUJARAT, INDIA.
15. CONDITIONS OF USE and Eligibility: You must be 18 years of age or older to register, use the Services, or visit or use the Website/App in any manner. By registering, visiting and using the Website and /or App or accepting this Agreement, you represent and warrant to Telidox that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website/App and the Services available through the Website/App, and agree to and abide by this Agreement.
16. UNIQUE IDENTITY NUMBER :The Telidox shall provide A unique Identity number to the patients, doctors and other health care practitioners, pharmacy, path labs and diagnostic centre The patient has to upload all the document related to his case history, Insurance, medical reports, prescriptions and other details. This information will be uploaded on theTelidox app. The registered user shall have complete access over this information and reports uploaded by patients and doctors. Unique application numbers: when you install or uninstall a Service containing a unique application number or when such a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.
17. Your Use of App And Services and tools are governed by the following terms and conditions as applicable to the app including the applicable policies which are incorporated herein by way of reference. If you transact on the app (web/mobile), you shall be subject to the policies that are applicable to the Website/App for such transaction. By mere use of the Application, you shall be contracting with Medicare Investigations Pvt. Ltd (MISPL)/ Telidox and these terms and conditions including the policies constitute your binding obligations, with Telidox.

21. Application terms: By using this Application, you agree to the terms of this Privacy Policy. Please read the following Privacy Policy to understand how your personal information will be treated as you use this Site and its services. Website Terms: By downloading and / or using this Application, you hereby agree to be bound by the Terms of Use Service, Privacy Policy, and other Policies as set forth on the website www.telidox.com . It is hereby further specified that all the Terms and Policies on the Website shall be coterminous to these terms.
23. For the purpose of these Terms of Use, along with any amendments to the same, and wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a user of the Application by installing the Application.
24. The headings of each section in this Agreement are only for the purpose of organising the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained with them in any manner. Further, the headings have no legal or contractual value. The terms used herein shall have the same meaning ascribed to them in the Terms of Service, Privacy Policy, and other policies available on the Website www.telidox.com. (“Website / Site”
25. PENDING CLAIMS: After termination of this Agreement, any provision of this Agreement that formed the basis of a valid claim by either party will remain in effect until the claim is settled.
26. BINDING NATURE OF THE AGREEMENT: The obligations under this Agreement will be binding upon and its benefits will inure to the benefit of the Parties and their respective successors
27. APPLICABLE LAW: The interpretation of this agreement and the resolution of any disputes arising under these terms of use shall be governed by the laws of India/ Countries of Africa such as Uganda. Though THE JURISDICTION AND ARBITRATION FOR ANY TECHNICAL, LEGAL, FINANCIAL, ADMINISTRATIVE OR ANY OTHER DISPUTE(S) WOULD BE VADODARA, GUJARAT, INDIA.
28. Registration/membership and manner of usage of account/ book appointment and call facility: It shall contained all the details of user profile after Registration and membership and manner of usage of account/ book appointment and call facility. You understand and acknowledge that You can register on the Site only after complying with the requirements and by entering Your Registration Data. You shall ensure that the Registration Data provided by You is accurate, complete, current, valid and true and is updated from time to time. We shall bear no liability for false, incomplete, old or incorrect Registration Data provided by You. You are solely responsible for maintaining the confidentiality of Your Registration Data and will be liable for all activities and transactions that occur through Your Account, whether initiated by You or any third party. Your Account cannot be transferred, assigned or sold to a third party. We shall not be liable for any loss that You may incur as a result of someone else using Your password or Account, either with or without Your knowledge.We reserve the right to suspend or terminate Your Account with immediate effect and for an indefinite period, if We have a reason to believe that the Registration Data or any other data provided by You is incorrect or false, or that the security of Your Account has been compromised in any way, or for any other reason We may find just or equitable.
29. Terms of use applicable to all users other than practitioners: The terms in this Clause are applicable only to Users other than Practitioners. A. END-USER ACCOUNT AND DATA PRIVACY: a) The terms “personal information” and “sensitive personal data or information” are defined under the SPI Rules, and are reproduced in the Privacy Policy. b) Telidox may by its Services, collect information relating to the devices through which you access the Website/App, and anonymous data of your usage. The collected information will be used only for improving the quality of Telidox’s services and to build new services. c) The Website/App allows Telidox to have access to registered Users’ personal email or phone number, for communication purpose so as to provide you a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice. d) The Privacy Policy sets out, inter-alia: i. The type of information collected from Users, including sensitive personal data or information; ii. The purpose, means and modes of usage of such information; iii. How and to whom Telidox will disclose such information; and, iv. Other information mandated by the SPI Rules. v. The User is expected to read and understand the Privacy Policy, so as to ensure that he or she has the knowledge of, inter-alia: a) the fact that certain information is being collected;b) the purpose for which the information is being collected; c) the intended recipients of the information; d) the nature of collection and retention of the information; and e) the name and address of the agency that is collecting the information and the agency that will retain the information; and f) the various rights available to such Users in respect of such information. vi. Telidox shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to Telidox or to any other person acting on behalf of Telidox. vii. The User is responsible for maintaining the confidentiality of the User’s account access information and password, if the User is registered on the Website/App. The User shall be responsible for all usage of the User’s account and password, whether or not authorized by the User. The User shall immediately notify Telidox of any actual or suspected unauthorized use of the User’s account or password. Although Telidox will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Telidox or such other parties as the case may be, due to any unauthorized use of your account. viii. If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Telidox has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Telidox has the right to discontinue the Services to the User at its sole discretion. ix. Telidox may use such information collected from the Users from time to time for the purposes of debugging customer support related issues. x. The information published under the head of "Industry wide city-wise Pricing Graph" is derived from a benchmarking group that is determined to be relevant by Telidox in the relevant city. Telidox has published this information for guidance purpose and does not have the ability to ascertain accuracy of the data based on which the information has been published and nor does it have any duty to disclose to anyone the source of the underlying data sets based on which this information has been published. Telidox is not liable in any manner for any consequence whatsoever arising out of any use of the information published here
B. Telidox’s relevance algorithm for the Practitioners is a fully automated system that lists the Practitioners, their profile and information regarding their Practice on its Website/App. These listings of Practitioners do not represent any fixed objective ranking or endorsement by Telidox. Telidox will not be liable for any change in the relevance of the Practitioners on search results, which may take place from time to time. The listing of practitioners, pharmacy, path labs and diagnostic centre will be based on automated computation of the various factors including inputs made by the Users including their comments and feedback. Such factors may change from time to time, in order to improve the listing algorithm. Telidox in no event will be held responsible for the accuracy and the relevancy of the listing order
C. LISTING CONTENT AND DISSEMINATING INFORMATION:
BOOK APPOINTMENT AND CALL FACILITY: Telidox enables Users to connect with Practitioners through one methods:

Late or missing refund (if applicable)
Telidox’s Service Provider fees is 15% of the consulting charges as charged by Practitioners/ HCP for that particular consultation. This would be charged before the deduction of applicable Taxation, conversion charges, bank charges and all other applicable expenses. The payment to the Practitioners/ HCP will be after deduction of the aforementioned charged.

· If you haven’t received a payment yet, first check your bank account again. Then contact your contact your bank. There is often some processing time before the payment is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at support@telidox.com, within 3 days of expected payment date or by 10th of the Next Month WIE.
· If no discrepancies are raised, the payment as received would be considered final and accepted by the Practitioners/ HCP.
· After the stipulated period has passed, and no further discrepancies such as of late or missing payment request or any other kind will be entertained.
i.
1. In the event that, the Practitioner with whom User has booked a paid appointment via the Website, has not been able to meet the User for any reasons and has failed to reschedule or inform the used of his unavailability, User will need to write to us at support@telidox.com within three (3) days from the occurrence of such event; in which case, the entire consultation amount as mentioned on the Website will be refunded to the User within the next five (5) to six (6) business days in the original mode of payment done by the User while booking [RG1] [SN(1[2] In case where the User, does not show up for the appointment booked with a Practitioner, without cancelling the appointment beforehand, the amount will not be refunded, and treated as no show[RG3] ( note . If the cancellation charges have been levied (as charged by the Practitioner/Practice), you would not be entitled to a complete refund even if you have cancelled beforehand.[RG4]
2. Users will not be entitled for any refunds in cases where, the user has not cancelled the appointment beforehand and is unable to meet the Practitioner at the exact time of the scheduled appointment time and the Practitioner is required to wait for more than stipulated time.
E. NO DOCTOR-PATIENT RELATIONSHIP; NOT FOR EMERGENCY USE:
1. Please note that some of the content, text, data, graphics, images, information, suggestions, guidance, and other material (collectively, “Information”) that may be available on the Website (including information provided in direct response to users’ questions or postings exchanged mutually between the user and the service provider) The provision of such Information does not create a licensed medical professional/patient relationship, between Telidox and users and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition, but is only provided to assist you with locating appropriate medical care from a qualified practitioner.
2. The emergency appointment will be provided to the patients but charges would be differ on circumstances and requirement.
3. It is hereby expressly clarified that, the Information that you obtain or receive from Telidox, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the Website is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the Website. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
4. The Services are not intended to be a substitute for getting in touch with emergency healthcare. If you are an End-User facing a medical emergency (either on your or a another person’s behalf), please contact an ambulance service or hospital directly.
F. TELIDOX HEALTH Journal
a. These terms & conditions governing Telidox Health Journal are applicable to Users (being both end-users/ Practitioner). However, it is clarified that the terms and conditions herein applicable only to Practitioners and applicable to Users are called out separately, as the context warrants.
b. Health Journal is an online content platform available on the Website, wherein Practitioners who have created a Telidox profile can login and post health and wellness related content.
c. Practitioners can use Telidox Health Journal by logging in from their account, creating original content comprising text, audio, video, images, data or any combination of the same (“Content”), taken from research, studies, references and any other source of information and uploading said Content to Telidox’s servers, at their own responsibility and liability and Telidox will have no responsibility in such a case. Telidox shall post such Content to Telidox Health Journal at its own option and subject to these Terms and Conditions. The Content uploaded via Telidox Health Journal does not constitute medical advice and may not be construed as such by any person.
d. Practitioners acknowledges that they are the original authors and creators of any Content uploaded by them via Telidox Health Journal and that no Content uploaded by them would constitute infringement of the intellectual property rights of any other person. Telidox reserves the right to remove any Content which it may determine at its own discretion as violating the intellectual property rights of any other person, including but not limited to patent, trademark, copyright or other proprietary rights. Practitioner agrees to absolve Telidox from and indemnify Telidox against all claims that may arise as a result of any third party intellectual property right claim that may arise from the Practitioner’s uploading of any Content on the Telidox Health Journal.
e. Practitioner hereby assigns to Telidox, in perpetuity and worldwide, all intellectual property rights in any Content created by the User and uploaded by the User via Telidox Health Journal.
f. Telidox shall have the right to edit or remove the Content and any comments in such manner as it may deem Telidox Health Journal at any time.
g. Practitioner shall ensure that the Content or any further responses to the Content (including responses to Users) is not harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic or libellous in any manner. Further, Practitioner should ensure that the Content is not invasive of any other person’s privacy, or otherwise contains any elements that is hateful, racially or ethnically objectionable, disparaging, or otherwise unlawful in any manner whatever. Telidox reserves the right to remove any Content which it may determine at its own discretion is violative of these Terms and Conditions or any law or statute in force at the time. Also, the Practitioner agrees to absolve Telidox from and indemnify Telidox against all claims that may arise as a result of any legal claim arising from the nature of the Content posted by the Practitioner on Telidox Health Journal.
h. Practitioner shall ensure that no portion of the Content is violative of any law for the time being in force.
i. Practitioner shall ensure that the Content is not threatening the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order. Further the Practitioner shall ensure that the Content will not cause incitement to the commission of any cognisable offence or prevent investigation of any offence or is insulting to any other nation.
j. User may also use Telidox Health Journal in order to view original content created by Practitioners and to create and upload comments on such Content, where allowed (“User Comment”).
k. User acknowledges that the User Comment reflects the views and opinions of the authors of such Content and do not necessarily reflect the views of Telidox.
l. User agrees that the Content they access on Telidox Health Journal does not in any way constitute medical advice and that the responsibility for any act or omission by the User arising from the User’s interpretation of the Content, is solely attributable to the User. The User agrees to absolve Telidox from and indemnify Telidox against all claims that may arise as a result of the User’s actions resulting from the User’s viewing of Content on Telidox Health Journal.
m. User acknowledges that all intellectual property rights in the User Comment on Telidox Health Journal vests with Telidox. The User agrees not to infringe upon Telidox’s intellectual property by copying or plagiarizing content on Telidox Health Journal. Telidox reserves its right to initiate all necessary legal remedies available to them in case of such an infringement by the User. Also, User Comment will be the sole intellectual property of Telidox. The User agrees not to post User Comment that would violate the intellectual property of any third party, including but not limited to patent, trademark, copyright or other proprietary rights. Telidox reserves the right to remove any User Comment which it may determine at its own discretion as violating the intellectual property rights of any third party. The User agrees to absolve Telidox from and indemnify Telidox against all claims that may arise as a result of any third party intellectual property right claim that may arise from the User Comment.
n. User shall ensure that the User Comment is not harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic or libellous in any manner. Further, User should ensure that the User Comment is not invasive of any other person’s privacy, or otherwise contains any elements that is hateful, racially or ethnically objectionable, disparaging, or otherwise unlawful in any manner whatever. Telidox reserves the right to remove any Content which it may determine at its own discretion is violative of these Terms and Conditions or any law or statute in force at the time Also, the User agrees to absolve Telidox from and indemnify Telidox against all claims that may arise as a result of any legal claim arising from the nature of the User Comment.
o. User shall ensure that the User Comment is not threatening the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order. Further the Practitioner shall ensure that the User Comment will not cause incitement to the commission of any cognisable offence or prevent investigation of any offence or is insulting to any other nation.
G. CONTENT OWNERSHIP AND COPYRIGHT CONDITIONS OF ACCESS
1. The contents listed on the Website are (i) User generated content, or (ii) belong to Telidox. The information that is collected by Telidox directly or indirectly from the End- Users and the Practitioners shall belong to Telidox. Copying of the copyrighted content published by Telidox on the Website for any commercial purpose or for the purpose of earning profit will be a violation of copyright and Telidox reserves its rights under applicable law accordingly.
2. Telidox authorizes the User to view and access the content available on or from the Website solely for ordering, receiving, delivering and communicating only as per this Agreement. The contents of the Website, information, text, graphics, images, logos, button icons, software code, design, and the collection, arrangement and assembly of content on the Website (collectively, "Telidox Content"), are the property of Telidox and are protected under copyright, trademark and other laws. User shall not modify the Telidox Content or reproduce, display, publicly perform, distribute, or otherwise use the Telidox Content in any way for any public or commercial purpose or for personal gain.
3. User shall not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
H. REVIEWS AND FEEDBACK
i. By using this Website, you agree that any information shared by you with Telidox or with any Practitioner will be subject to our Privacy Policy.
ii. You are solely responsible for the content that you choose to submit for publication on the Website, including any feedback, ratings, or reviews (“Critical Content”) relating to Practitioners or other healthcare professionals. The role of Telidox in publishing Critical Content is restricted to that of an ‘intermediary’ under the Information Technology Act, 2000 or other relevant locally applicable law of respective countries Telidox is operating in or would operate in future. Telidox disclaims all responsibility with respect to the content of Critical Content, and its role with respect to such content is restricted to its obligations as an ‘intermediary’ under the said Act. Telidox shall not be liable to pay any consideration to any User for re-publishing any content across any of its platforms.
iii. Your publication of reviews and feedback on the Website is governed by above clause of these Terms. Without prejudice to the detailed terms stated in above clause, you hereby agree not to post or publish any content on the Website that (a) infringes any third-party intellectual property or publicity or privacy rights, or (b) violates any applicable law or regulation, including but not limited to the IG Rules and SPI Rules. Telidox, at its sole discretion, may choose not to publish your reviews and feedback, if so required by applicable law, and in accordance with Clause 5 of these Terms. You agree that Telidox may contact you through telephone, email, SMS, or any other electronic means of communication for the purpose of:
iv. Obtaining feedback in relation to Website or Telidox’s services; and/or
v. Obtaining feedback in relation to any Practitioners listed on the Website; and/or
vi. Resolving any complaints, information, or queries by Practitioners regarding your Critical Content;and you agree to provide your fullest co-operation further to such communication by Telidox. Telidox’s Feedback Collection and Fraud Detection Policy, is annexed as the Schedule hereto, and remains subject always to these Terms.
I. RECORDS:
Telidox
may provide End-Users with a free facility known as ‘Record’ also known
as ‘medical history’ on its mobile application ‘Telidox’. Information available
in your Records is of two types:
User-created: Information uploaded by you or information generated during your interaction with Telidox ecosystem, eg: appointment, medicine order placed by you etc.
Practice-created: Health Records generated and prescribed/given to you by your interaction with a Practitioner who uses ‘Telidox or other Services of Telidox software. Any other document which the doctor generates for the patient except the prescription or requestion such as medical notes or case notes or known by any such other name, taken by the doctor will not be accessible by the patient and would strictly remain confidential between Telidox and the Practitioner. Access may be granted under special circumstances to be decided on a case to case basis at the sole discretion of Telidox.
The specific terms relating to such Health Account are as below, without prejudice to the rest of these Terms and the Privacy Policy:
o Your Records are only created after you have signed up and explicitly accepted these Terms.
o Any Practice created Health Record is provided on an as-is basis at the sole intent, risk and responsibility of the Practitioner and Telidox does not validate the said information and makes no representation in connection therewith. You should contact the relevant Practitioner in case you wish to point out any discrepancies or add, delete, or modify the Health Record in any manner.
o The Health Records are provided on an as-is basis. While we strive to maintain the highest levels of service availability, Telidox is not liable for any interruption that may be caused to your access of the Services.
o It is your responsibility to keep your correct mobile number and email ID updated in the Records. The Health Records will be sent to the Records associated with this mobile number and/or email ID [RG5] [SN(1[6] [RG7] and would also be stored within the Telidox APP. Every time you change any contact information (mobile or email), we will send a confirmation. Telidox is not responsible for any loss or inconvenience caused due to your failure in updating the contact details with Telidox.
o Telidox uses industry–level security and encryption to your Health Records. However, Telidox does not guarantee to prevent unauthorized access if you lose your login credentials or they are otherwise compromised. In the event you are aware of any unauthorized use or access, you shall immediately inform Telidox of such unauthorized use or access. Please safeguard your login credentials and report any actual suspected breach of account to support@telidox.com.
o If you access your dependents’ Health Records by registering your dependents with your own Records, you are deemed to be responsible for the Health Records of your dependents and all obligations that your dependents would have had, had they maintained their own separate individual Records. You agree that it shall be your sole responsibility to obtain prior consent of your dependent and shall have right to share, upload and publish any sensitive personal information of your dependent. Telidox assumes no responsibility for any claim, dispute or liability arising in this regard, and you shall indemnify Telidox and its officers against any such claim or liability arising out of unauthorized use of such information.
o In case you want to delete your Records, you can do so by contacting our service support team. However only your account and any associated Health Records will be deleted, and your Health Records stored by your Practitioners will continue to be stored in their respective accounts.
o You may lose your “User created” record, if the data is not synced with the server.
o If the Health Record is unassessed for a stipulated time, you may not be able to access your Health Records due to security reasons.
o Telidox is not liable if for any reason, Health Records are not delivered to you or are delivered late despite its best efforts.
o Telidox is not responsible or liable for any content, fact, Health Records, medical deduction or the language used in your Health Records whatsoever. Your Practitioner is solely responsible and liable for your Health Records and any information provided to us including but not limited to the content in them.
o Telidox has the ability in its sole discretion to retract Health Records without any prior notice if they are found to be shared incorrectly or inadvertently.
o Telidox will follow the law of land in case of any constitutional court or jurisdiction mandates to share the Health Records for any reason.
o You agree and acknowledge that Telidox may need to access the Health Record for cases such as any technical or operational issue of the End User in access or ownership of the Records.
o You acknowledge that the Practitioners you are visiting may engage Telidox's software or third party software for the purposes of the functioning of the Practitioner’s business and Telidox's services including but not limited to the usage and for storage of Records (as defined in Section 3.10) in India and outside India, in accordance with the applicable laws.
o To the extent that your Records have been shared with Telidox or stored on any of the Telidox products used by Practitioner’s you are visiting, and may in the past have visited, You hereby agree to the storage of your Records by Telidox pertaining to such previously visited clinics and hospitals who have tie ups with Telidox for the purposes of their business and for Telidox's services including but not limited to the usage and for storage of Records in India and outside India, in accordance with the applicable laws and further agree, upon creation of your account with Telidox, to the mapping of such Records as may be available in Telidox’s database to your User account.
J. Information uploaded by you on the app(stored in secure server maintained by Telidox and would be encrypted at( data capacity): You understand that you may have the option of uploading your health / medical information on the Website in order to enable your doctor to access your previous medical history. While Telidox takes utmost care with respect to the security of the information you decide to upload, you understand that any information that you disclose on the website is at your own risk. By uploading / sharing / disclosing your medical information on the App, you hereby give your consent to app to store such health / medical information on Telidox's servers. Telidox will retain such medical / health information you upload on the app for as long as it is needed to full fill the service you seek to avail on the app. If you delete your account, Telidox will delete such medical / health information. kindly note that:
a. There might be some latency in deleting this information from our servers and backup storage.
b. We may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.
K. Telidox Pay
i. Telidox Pay is a grant of benefit in the form of credits in the Telidox accounts of the Users (“Telidox Pay”) in the form and under such circumstances decided by Telidox from time to time.
ii. Telidox Pay can be redeemed by the User only to pay online for the following services on the Website:
(The above services on the Website are collectively referred to as “Permitted Services”.)
o Every time a User using (i) Android version 4.31 or above; or (ii) iOS version 4.24 or above of the Telidox mobile application; or (iii) the Telidox website (www.telidox.com), uses Telidox Pay to pay online for any of the Permitted Services availed by him/her, only such percentage of the total amount to be paid for the availed Permitted Services, as may be prescribed by Telidox from time to time on the respective Telidox mobile application or website ( www.telidox.com ), can be redeemed by such User using the Telidox Pay per transaction.
o Telidox Pay neither can be converted to actual money nor can be transferred to any bank accounts.
o The Telidox Pay received by each User may or may not have an expiry date associated with it and the said expiry date is subject to the following:
. The expiry date associated with Telidox Pay may vary from time to time. However, the same cannot exceed beyond 2 (Two) years
i. The expiry date of Telidox Pay may be intimated to each User by way of SMS or e-mail or in-App notification on the Website.
ii. The expiry date of Telidox Pay can be viewed by each User in the designated page for Telidox Pay in the Website.
iii. The User acknowledges that Telidox has agreed to offer Telidox Pay in its sole discretion. Nothing in these Terms shall be interpreted to restrict Telidox’s right to withdraw the Telidox Pay before the expiry date.
o Telidox reserves its discretion to deny Telidox Pay to any User in its sole discretion, notwithstanding compliance by such User of the requirements set out in the Terms, applicable law or otherwise.
o Other than the conditions set out in these Terms, accrual, utilization, expiry or any other treatment of Telidox Pay may be further restricted by the terms governing the specific service or facility offered by Telidox or its business associates, the procurement of which entitles Telidox Pay to a User (“Telidox Pay Terms”). In the event of any inconsistency between these Terms and the Telidox Pay Terms in relation to accrual, utilization, expiry or any other treatment of Telidox Pay by a User, the Telidox Pay Terms shall override these Terms to the extent of such inconsistency.
L. TERMS OF USE PRACTITIONERS:
The terms are applicable only to Practitioners.
i. LISTING POLICY: Telidox, directly and indirectly, collects information regarding the Practitioners’ profiles, contact details, and practice. Telidox reserves the right to take down any Practitioner’s profile as well as the right to display the profile of the Practitioners, with or without notice to the concerned Practitioner. This information is collected for the purpose of facilitating interaction with the End-Users and other Users. If any information displayed on the Website in connection with you and your profile is found to be incorrect, you are required to inform Telidox immediately to enable Telidox to make the necessary amendments.
ii. Telidox shall not be liable and responsible for the ranking of the Practitioners on external websites and search engines
iii. Telidox shall not be responsible or liable in any manner to the Users for any losses, damage, injuries or expenses incurred by the Users as a result of any disclosures or publications made by Telidox, where the User has expressly or implicitly consented to the making of disclosures or publications by Telidox. If the User had revoked such consent under the terms of the Privacy Policy, then Telidox shall not be responsible or liable in any manner to the User for any losses, damage, injuries or expenses incurred by the User as a result of any disclosures made by Telidox prior to its actual receipt of such revocation.
iv. Telidox reserves the right to moderate the suggestions made by the Practitioners through feedback and the right to remove any abusive or inappropriate or promotional content added on the Website. However, Telidox shall not be liable if any inactive, inaccurate, fraudulent, or non- existent profiles of Practitioners are added to the Website.
v. Practitioners explicitly agree that Telidox reserves the right to publish the Content provided by Practitioners to a third party including content platforms.
vi. When you are listed on Telidox.com, End-Users may use Chat, voice call, and video call feature to interact with the doctor. When End-Users choose this option, they choose to connect with you to the through the Chat, voice call, and video call provided by Telidox, and the records of such calls are recorded and stored in Telidox’s servers. Such a voice call, and video call may have an IVR message stating the purpose of recording your calls and your consent to such recordings which are dealt with as per the Privacy Policy. Such records may be accessed by Telidox for quality control and support related purposes and are dealt with only in accordance with the terms of the Privacy Policy. Telidox accepts no liability if the Chat, voice call, and video call facility is not used in accordance with the foregoing. In case you choose to not provide your consent to recording your calls that may have personal information required for appointment and booking purposes, Telidox reserves the right to not provide the Services for which such personal information is sought.
vii. You as a Practitioner hereby represent and warrant that you will use the Services in accordance with applicable law. Any contravention of applicable law as a result of your use of these Services is your sole responsibility, and Telidox accepts no liability for the same.
M. PROFILE OWNERSHIP AND EDITING RIGHTS: Telidox ensures easy access to the Practitioners by providing a tool to update your profile information. Telidox reserves the right of ownership of all the Practitioner’s profile and photographs and to moderate the changes or updates requested by Practitioners. However, Telidox takes the independent decision whether to publish or reject the requests submitted for the respective changes or updates. You hereby represent and warrant that you are fully entitled under law to upload all content uploaded by you as part of your profile or otherwise while using Telidox’s services, and that no such content breaches any third party rights, including intellectual property rights. Upon becoming aware of a breach of the foregoing representation, Telidox may modify or delete parts of your profile information at its sole discretion with or without notice to you.
a. For the purpose of these Terms of Use, along with any amendments to the same, and wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a user of the Application by installing the Application.
b. The headings of each section in this Agreement are only for the purpose of organising the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained with them in any manner. Further, the headings have no legal or contractual value. The terms used herein shall have the same meaning ascribed to them in the Terms of Service, Privacy Policy, and other policies available on the Website www.telidox.com (“Website / Site”)
c. By using the App, You accept and agree to be bound by this Agreement, the Privacy Policy, as well as rules, guidelines, policies, terms, and conditions applicable to any service that is provided by this Application, including the Terms and Polices on the Website that shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. Your use of Our Application is evidence that You have read and agreed to be contractually bound by these Terms of Service and our Privacy Policy. Please read the terms carefully. The use of this Application by You is governed by this policy and any policy so mentioned by terms of reference.
d. If you do not agree with any of these terms, please discontinue using the Application.
e. We hold the sole right to modify the Terms of Service without prior permission from You or providing notice to You. The relationship creates on You a duty to periodically check the Terms of Service and stay updates on its requirements. If You continue to use the Application or avail of its services following such change, it is deemed as consent by You to the so amended policies. Your continued use of the Application is conditioned upon your compliance with the Terms of Service, including but not limited to compliance with the Terms of Service even after alterations, if any.
N. Information Collected:
We may collect the following information:
1. Personal data of the User such as, but not limited to, Your name, Your age, date of birth, occupation and gender;
2. The User’s e-mail and contact information, GPS based location;
3. The User’s tracking Information such as, but not limited to the device ID, Google Advertising ID and Android ID;
4. The User’s data sent across through the Application.
As a User of , you may provide information about yourself, your spouse or family, your friends, their health issues, gender of the patient, age of the patient, previous medication taken, previous medical conditions, allergies, etc.
The Information specified above and collected by us may be classified as ‘Personal Information’ or ‘Sensitive Information’ under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. Collection of information which has been designated as ‘sensitive personal data or information’ under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such collection as required under applicable law. Our Services may be unavailable to you in the event such consent through an email is not given.
For Practitioners using , we would collect your Name, Education, Specialization, address of practicing hospitals/clinics, Contact information, achievements, Device ID (IMEI), Location, etc. If you use by accessing it through your Google and Facebook Profiles and other API’s, we collect such data as well.
f. 4. External Links on The Application
g. The Application may include offers from our vendors, advertisements, hyperlinks to other websites, applications, content or resources. We have no control over such external links present in the Application, which are provided by persons or companies other than Us.
h. You acknowledge and agree that We are not responsible for any collection or disclosure of your Personal Information by any external sites, applications, companies or persons, nor are do We endorse any advertising, products or other material on or available from such external application, websites or resources.
i. You further acknowledge and agree that We are not liable for any loss or damage which may be incurred by You as a result of the collection and/or disclosure of Your personal information by external applications, sites or resources, or as a result of any reliance placed by You on the completeness, accuracy or existence of any advertising, products or other materials on, or available from such applications, websites or resources. These external applications, websites and resource providers may have their own privacy policies governing the collection, storage, retention and disclosure of Your Personal Information that You may be subject to. We recommend that You enter the external application or website and review their privacy policy.
j. We may allow third parties/individuals to display advertisements when you use the Application.
O. Our Use of Your Information:
i. The information provided by You shall be used to contact You when necessary. For more details about the nature of such communications, please refer to out Terms of Service. We use Your tracking information to help identify you and to gather broad demographic information. The information is also used to customise your experience of using .
ii. We may release your Personal Information to a third-party in order comply with a Court Order or other similar legal procedure, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of Our Terms of Use. iii. The information made available by Patients is displayed to Practitioners and vice versa. The information collected from Practitioners is displayed on the Application to enable a User to connect with a Practitioner of their choice.
P. Sharing of information uploaded by you on the app it would be shared to doctors, labs and pharmacies who are registered with Telidox on a need to know basis only. Unless you specifically consent to share information, medical or otherwise, with either doctors or third party service providers, app does not share such information that you upload on the app. While Telidox takes utmost care with respect to the security of the information you decide to share, you understand that any information that you disclose on the website is at your own risk. In the event you do not trust Telidox with such information, please do not share such information on the app, while Telidox endeavours to protect any information uploaded or shared by you on the website, you understand that Telidox shall not be held liable or responsible for the loss or damage to such information on the app. It is your responsibility to ensure that you have all your information, medical or otherwise, stored on your hard drive. You hereby agree not to use the website as an "external storage" to store your medical / health records.
Q. COLLECTION OF CONSULTATION FEES
You understand that Telidox provides various services with respect to the System. While some of these services are provided for free, there are certain services for which costs will be incurred by you, if you decide to avail such services ("paid services"). In that case, Telidox may provide billing services on behalf of the doctor or health care professional. Should you wish to avail those paid services, you acknowledge that Telidox will collect the payment for such paid services for and on behalf of the doctor or healthcare professional providing such clinical services. You acknowledge and confirm that Telidox shall not be liable for the treatment or be treated as the health care provider on account of such collection of the payments or for provision of such paid services, for any reason what so ever.
R. CLINICAL SUPPORT INFORMATION
We may provide information to assist you in clinical decision-making. This may include information and reminders concerning drug interactions, allergies, dosages, as well as general health-care related information and resources.. The information and materials available through the app are for informational and educational purposes only and are not intended to constitute professional advice, diagnosis or treatment, or to substitute for your professional judgment.
Information that may be placed on the app by third parties are beyond our control. We are not responsible for the accuracy or completeness of information available from or through our app. You assume full risk and responsibility for the use of information you obtain from or through this app, and you agree that Telidox is not responsible or liable for any claim, loss, or liability arising from the use of the information. We do not recommend or endorse any provider of healthcare or health-related products, items or services, and the appearance of materials on the app relating to any such products, items or services is not an endorsement or recommendation of them. You agree to review the definitions, functionality, and limitations of the services, and to make an independent determination of their suitability for your use.
S. SELECTING YOUR DOCTOR OR HEALTHCARE PROVIDER ON THE APP
The App allows you to select and schedule appointments with doctors and health care providers registered with the website and to whom certain specific terms Telidox. While choosing your doctor or healthcare provider on the App, you understand and accept that:
· You are ultimately responsible for choosing your own doctor or healthcare provider and Telidox shall not be held responsible or liable for the selection of such doctor or healthcare provider.

Telidox will
provide you with lists and/or profile previews of doctors and health care
providers who may be suitable to deliver the health care that you are seeking
based on information that you provide to Telidox (such as area of
specialty and geographical location). For certain specific services, Telidox may
choose a doctor or healthcare provider on your behalf based on the nature of
services you request and on the doctor or healthcare professional available to
provide you with the clinical services for the same.
Please note that Telidox
· Does not recommend or endorse any doctors or health care providers mentioned on the app.
· Does not make any representations or warranties with respect to these doctors or health care providers or the quality of the healthcare services they may provide. Telidox shall not be liable for any reason whatsoever for the services provided by the health care professional or doctor, and we bear no liability for the consequences to you, of your use of the system or services.
Information regarding doctors and health care providers and practice information found on the app is intended for general reference purposes only. Such information found on the app is mainly self-reported by the doctor or the health care provider. Such information often changes frequently and may become out of date or inaccurate. Neither the app nor Telidox provides any advice or qualification certification about any particular doctor or healthcare provider. You are encouraged to independently verify any such information you see on the website with respect to a doctor or healthcare provider that you seek to make an appointment with.
T. Disclosure of Your Information to Third Parties: When you use our Application, we must provide some of your personal information to third parties (like medical reports , doctor’s prescription, medical history, patient name and family medical history etc.) to give you better services and for enhancement and visibility of our Application. However, we do not sell or rent individual customer names or other Personal Information to third parties except sharing of such information with our alliance partners or vendors who are engaged by us for providing various promotional and other benefits to our customers from time to time.
U. Due to the existing regulatory environment, we cannot ensure that all of your information shall never be disclosed in ways other than those described in this Privacy Policy. For example, but without limiting and foregoing, we may be forced to disclose Your Personal Information to the government, law enforcement agencies or other Third Parties. Under certain circumstances, Third Parties may unlawfully intercept or access transmission or private communications, or abuse or misuse Your Personal Information that they may collect from our Application. 1. We may share our data, including Your Personal Information, with our parent and/or subsidiaries that are committed to serving your needs through use of our Application and related services, throughout the world..
2. We cooperate with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights. We can, and You so authorise Us, disclose Your Personal Information to law enforcement and other government officials as We, in Our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose Us/ Us or You to any legal liability.
3.We gather up data such as personally identifiable information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for other marketing and promotional purposes. Without limitation to the foregoing, in the event you are barred from undertaking legally binding obligations under the Indian Contract Act, 1872, or are for any reason, unable to provide ‘Consent’ as per the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, you are not eligible to
W. Without limiting any other provisions of these Terms, you may not use this Application for any purpose that is unlawful or prohibited by these Terms and/or any applicable additional terms. Your access of this Application may be terminated immediately, in our sole discretion, with or without notice, if you fail to comply with any provision of these Terms and/or additional terms, or for any other reason, or no reason.
X. Intermediary Application
The Website is a platform that Patients and Practitioners utilize to meet and interact with one another for their transactions. We act as aggregators who display to the End User / Patients Practitioners best suited to your needs, based on the Content provided to us / updated on the Website / updated on the Mobile Application, or applications built on it, by Practitioners and End Users, including without limitation Content relating to area of Practitioner area of specialization, expertise, experience, availability, and geographic location.
However, should a User choose to proceed with a Practitioner displayed / identified / listed by us, for any purpose whatsoever, outside Telidox including without limitation, posing a question, seeking medical advisory service, exchanging Patient information, charts, DICOM Images, seeking appointments, we advise strongly against such an interaction and we are not a party to such interaction and take no liability arising from such communication. Y. Communications
By using this Application, it is deemed that You have consented to receiving telephonic calls, SMSs and/or emails from us and other Users. Such communications shall be sent to You on the telephone number and/or email id provided by You for the use of this Application which are subject to our Privacy Policy. Such communication by Us is for purposes that inter alia include clarification calls, marketing calls and promotional calls.
In the event you use the Application to book appointments with any Practitioner, We may send booking confirmation, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS, Chat, or by voice call on the contact number provided by You at the time of making the appointment. This includes contacting you through information received from other parties. This consent to be contacted is for purposes that include and are not limited to clarification calls and marketing and promotional calls.
Z. Practitioner Display
Telidox collects, directly or indirectly, and displays on the Application, relevant information regarding the profile and practice of the Practitioners listed on the Application, such as their specialization, qualification, area of practice, experience, fees, location, visiting hours, and similar details. Although we take reasonable efforts to ensure that such information is accurate and updated at frequent intervals, we cannot be held liable for any inaccuracies or incompleteness represented on the Application pertaining to Practitioner Content.
It is hereby expressly clarified that, the Information that you obtain or receive from , is for informational and User’s personal purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information pertaining to the Practitioners provided on the Website.
In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information. Telidox is not meant to be a substitute for Emergency Medical Care.
X. Disclaimers
1. Telidox does not support any Practitioners displayed / made available through the Application.
2. Telidox assumes no liability for the repercussions of using the application for the purpose of transmitting User’s medical / personal data to any other User, including without limitation, loss of data, failure to boot, or other errors in the working of the device on to which the application has been downloaded.
3. Telidox is an application used by Practitioners to promote their Services. By using , the User understands and accepts that does not endorse any Practitioner’s services.
4. Any
disputes arising out of the use of shall be governed by the law, rules and
regulations of India, as applicable in the State of Gujarat . The
exclusive jurisdiction and venue for actions and disputes shall be the courts
located in Vadodara, Gujarat, India.
Y. User’s Obligations
The User undertakes to fulfil the following obligations. Failure to satisfy any of these obligations gives Us the right to permanently suspend Your account and/or claim damages for any losses that accrue to Us or additional costs that may be imposed on us.
1. You hereby certify that you are at least 18 years of age.
2. You agree to comply with all local laws and regulations governing the downloading, installation and/or use of the Application, including, without limitation, any usage rules set forth in this Agreement.
3. You undertake not to:
1. Cut, copy, distribute, modify, recreate, reverse engineer, distribute, post, publish or create derivative works from, transfer, or sell any information or software obtained from the Application. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Application is not permitted. Should You want to engage in one or more such actions, prior permission from Us must be obtained.
2. Access (or attempt to access) the Application and/or the materials or Services by any means other than through the interface that is provided by the Application. The use of deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Application or Content, or in any way reproduce or circumvent the navigational structure or presentation of the Application, materials or any Content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the Application is prohibited. You acknowledge and agree that by accessing or using the Application or Services, You may be exposed to content from other Users or Third Parties that You may consider offensive, indecent or otherwise objectionable. We disclaim all liabilities arising in relation to such offensive content on the Application. Further, You may report such offensive content.

Probe, scan or test the vulnerability of the Application or any network connected to the Application, nor breach the security or authentication measures on the Application or any network connected to the Application. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Application, or exploit the Application or Service or information made available or offered by or through the Application, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Application;
8. Disrupt or interfere with the security of, or otherwise cause harm to, the Application, systems resources, servers or networks connected to or accessible through the Applications or any affiliated or linked applications;
9. Violate any applicable laws or regulations for the time being in force within or outside India;
10. Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;
Z. Updates
From time to time, the Application may automatically check the version of the Application installed on the Device and, if applicable, provide updates for the Application (hereinafter referred to as “Updates”). Updates may contain, without limitation, bug fixes, patches, enhanced functionality, plug-ins and new versions of the Application. By installing the Application, You authorize the automatic download and installation of Updates and agree to download and install Updates manually if necessary. Your use of the Application and Updates shall be governed by this Agreement (as amended by any terms and conditions that may be provided with Updates).
AA. Actions Undertaken on Your Device:
Upon download and installation of the Application, You grant the following permissions to the Applications to perform the following actions on the device You have installed the Application in.
1. To read from, write on, modify and delete data pertaining to the Application on the device’s hard disk and/or external storage;
2. To access information about networks, access networks including Wi-Fi networks, receive and send data through the network;
3. To determine Your approximate location from sources like, but not limited to mobile towers and connected Wi-Fi networks;
4. To determine Your exact location from sources such as, but not limited to GPS.
5. To access the model number, IMEI number and details about the operating system of the device the Application has been installed on, as well as the phone number of the device.
6. To retrieve information about other applications running on the device the Application has been installed on and open them.
7. To detect when the phone had been switched off and switched on for the purpose of sending notification/ push notifications.
8. To access and change the display and sound settings of the device the Application has been installed in.

10. Refunds, Cancellations, Disputes and Chargebacks
1. No cancellation or refunds are permitted in .

In exceptional cases, User may submit a claim for a refund for a purchase by emailing support@telidox.com and providing a clear and specific reason for the refund request and the exact terms that have been violated. Whether a refund will be provided will be determined by Company in its sole discretion. Refund requests must be submitted within 30 days of purchase.
11. Copyright
1. All information, content, services and software displayed on, transmitted through, or used in connection with the Application, including for example text, photographs, images, illustrations, audio clips, video, html, source and object code, trademarks, logos, and the like (collectively and hereinafter referred to as the “App Content”), as well as its selection and arrangement, is owned by Us and other Third Parties. You may use the App Content only through the Application, and solely for your personal, non-commercial use.
2. You may not, republish any portion of the App Content on any Internet, Intranet or extranet site or incorporate the App Content in any database, compilation, archive or cache. You may not distribute any App Content to others, whether or not for payment or other consideration, and you may not modify, copy, frame, cache, reproduce, sell, publish, transmit, display or otherwise use any portion of the App Content. You may not scrape or otherwise copy the App Content without permission. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Application; not to insert any code or product or manipulate the content of the Application in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method.
